Brutal Mario on eBay and other Mario Hacks

I was browsing eBay last night and noticed the popular hack Brutal Mario and other hacks of Super Mario World listed on eBay. However, that's not what got me - these are listed on eBay in game cartridge form and, sometimes, even with custom packaging! How did people do that? And how are they selling some of these cartridges for $40? And with people actually buying them? Are these legal consequences involved? What do you all think of this? How do you put a hacked Mario game onto a cartridge? I though the ROM was read only EPROM. Are they using some new kind of flash ROM?
